Thank you for choosing 207 Undercoating (the “Service”). The Service is operated by Rust Stop, LLC, doing business as (dba), 207 Undercoating (“Rust Stop”, “207 Undercoating”, “we”, “us”, or “our”). These Terms of Service (“Terms”) govern the service and by using the Service you agree to be bound by the Terms as written with no modification or amendments.

207 Undercoating is a mobile vehicle and equipment rust protection service. We provide services at a place of your choosing, ensuring that your vehicle is professionally protected against rust and corrosion. To ensure the highest quality service and the safety of property, customers, and employees, all services are subjected to these Terms of Service. These conditions are subject to change without notice. We reserve the right to terminate your use of this service at any time for any reason or no reason at all.

Headers are provided purely for convenience and navigation purposes and shall not be considered an indication of the content or modify the intention or content written in any way.

Service Requirements

In order to provide services, we require that all of the below requirements are met to ensure the highest quality of service and the safety of staff, customers, and property.

  1. Customers are responsible for obtaining permission for services to be performed on the property decided on, for most, this permission is implied as the customer is the property owner;
  2. Keys to all vehicles must be provided so the technician is able to elevate the vehicle. Customers will not be permitted to drive their vehicle onto Rust Stop owned ramps.
  3. A space with at least 3 feet around all sides of the vehicle is required to ensure proper access.

Please Note: If services cannot be completed because the noted conditions are not met, the customer will be responsible for payment of no less than 30% of the total quoted price, regardless of the amount of work able to be performed.

Payment Policies & Service Fees

The balance of the service is due at the time of service unless otherwise agreed upon by an authorized representative of 207 Undercoating.

Deposit to Hold Appointment

Upon scheduling an appointment, customers will be sent an invoice link by email and text message to pay a deposit on the appointment. Invoices outstanding for 72 hours or longer will be considered unpaid and the appointment canceled. Deposits are not refundable, but will be taken off the total invoice due at the time of service.

Methods of Payment

We accept cash, personal and business checks, Venmo, and most major credit cards. The method of payment used for an appointment deposit is not required to be used for the remaining balance of the account.

Coupons, Discounts, and Promotions

207 Undercoating, at their sole discretion, may elect to issue coupons, discounts, and promotions. All discounts will have a set of parameters surrounding them (e.g., a percentage discount, dollar amount discount, etc.). These parameters will be available on the delivery method of the code (e.g., physical coupon, email, social media post, etc.). Any promotions may be terminated at any time without notice. Promotions may not be resold or distributed outside of the defined distribution plan. Promotions may not be redeemed for cash. Only one promotion per service appointment. Promotions must be redeemed during a transaction or at sign-up. Promotions may not be applied retroactively.

Refunds

Services already rendered will not be refunded. Deposits made on service appointments will not be refunded under any circumstance. Exceptions to this policy may be made at the sole and exclusive discretion of 207 Undercoating. Should a refund be offered, it will be returned to the original method of payment less actual fees assessed to 207 Undercoating (e.g., processing fees, etc.).

Schedule of Fees

207 Undercoating is committed to ensuring transparency of cost to our customers. If 207 Undercoating determines that a fee is required, those fees will be charged following the below schedule of fees. All fees are in addition to any assessed service fees. This fee schedule is not exhaustive, as actual damages or charges may be assessed in certain circumstances.

Returned Payment Fee – assessed for insufficient funds or returned items by our financial institution. Customers will be assessed a $35 fee per returned item plus any actual fees assessed by our financial institution.

Late Payment Fee – assessed on invoices that have been outstanding for more than 30 days. Customers will be assessed a fee of 5% per month for every 30 day period the invoice is overdue.

Service Cancelation & Change

Rescheduling an Appointment

Customers may contact our team at 207-910-7878 or hello@207undercoating.com to request an appointment be rescheduled. There is no cost to reschedule an appointment and your deposit will be carried to the new appointment. Customers may reschedule an appointment up to two (2) times before the appointment is canceled and the deposit is forfeited.

Customers are asked to provide as much advanced notice as possible to reschedule an appointment. Appointments rescheduled with less than 24 hours notice of the appointment will forfeit the deposit made and be required to pay an additional deposit.

Cancellation of Appointment

Customers may reschedule their appointment with no penalty as per the terms outlined above. Customers who wish to cancel their appointment will forfeit any deposits made on the appointment. Should the customer schedule an appointment in the future, the deposit will not be credited to the new appointment.

Appointments cancelled with less than 24 hours notice will be charged 50% of the quoted visit cost.

Cancellation or Rescheduling Due to Weather or Unforeseen Circumstances

At times, 207 Undercoating may need to cancel an appointment due to weather or other unforeseen circumstances to ensure the highest quality service and the safety of all. In these circumstances 207 Undercoating will reschedule the appointment at no additional cost to the customer with all deposits paid to be credited to the rescheduled appointment. In circumstances where cancellation or rescheduling is initiated by 207 Undercoating, customers may elect to cancel their appointment and receive a refund of their deposit. 

Guarantees and Warranties

207 Undercoating uses industry standard application processes, procedures, and equipment. The Service and all products and services purchased, delivered, and/or provided to you through the Service are provided “as is” and “as available”, without any representations or warranties, either express or implied.  We disclaim all implied warranties or conditions of merchantability, fitness for a particular purpose, durability, title, and non-infringement. No communication with 207 Undercoating may be construed as a warranty or guarantee of any kind.

Waiver of Liability

To the extent permitted by law, in no event shall 207 Undercoating, our directors, officers, employees, affiliates, agents, contractors, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the Service or any products procured using the Service, or for any other claim related in any way to your use of the Service or any product, including, but not limited to, any loss or damage of any kind incurred as a result of the use of the Service or any content (or product) posted, transmitted, or otherwise made available via the Service, even if advised of their possibility. Our maximum liability for your use of the Service is equal to the fees paid by you to us for the individual vehicle or piece of equipment serviced.

Indemnification

You shall indemnify, defend, and hold us harmless from and against any and all claims, losses, expenses, demands, or liabilities, including reasonable attorneys’ fees and costs, incurred by us in connection with any claim by a third party (including any intellectual property claim) arising out of your use of the Service or your violation of any applicable law. You further agree that you will cooperate fully in the defense of any such claims. We reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, and you shall not in any event settle any such claim or matter without our written consent.

Jurisdiction

This Agreement shall be governed by and construed in accordance with the substantive laws of the State of Maine and the customer consents to the jurisdiction of courts, both state or federal, in Maine, with respect to any dispute under this Agreement.

Severability

In case any provision in these Terms & Conditions shall be invalid, illegal, or unenforceable, the validity, legality, and enforceability of the remaining provisions shall not in any way be affected or impaired thereby and such provision shall be ineffective only to the extent of such invalidity, illegality or unenforceability.

Questions, Comments, & Concerns

It is expected that customers make a good-faith effort to remedy any question, comment, or concern. Customers agree to provide 207 Undercoating a reasonable opportunity to resolve any concerns or complaints prior to taking any additional course of action, including, but not limited to credit card chargebacks, formal complaints, public posts, and/or legal proceedings. Customers must make a good faith effort to contact 207 Undercoating and provide us with at least 2 business days to resolve issues identified. Customers who fail to provide 207 Undercoating this opportunity forfeit any ability to seek remedies of any kind.
